Amendment C174port has been approved by the Minister for Planning's delegate. The amendment came into effect on 15 October 2020.

Amendment C174port proposes to implement the recommendations of the Tiuna Grove Heritage Assessment (Peter Andrew Barrett, 2019). It does this by:

The Amendment proposes to update the Citation for the HO8 precinct which is included in the Port Phillip Heritage Review (Incorporated Document). The changes seek to bring the Citation in line with recognised standards of practice in writing statements of significance, as outlined in Planning Practice Note 1: Applying the Heritage Overlay (August 2018), and clearly outline what, how and why the precinct is significant.
The Planning Panel report was received by Council on 5 May 2020. In accordance with section 26 of the Planning and Environment Act 1987, the report was made available for public inspection by 2 June 2020.
Council formally considered the Panel report and recommendations at its meeting on 1 July 2020.
Due to the Victorian Government’s State of Emergency declared on 16 March 2020 for the COVID-19 pandemic, a Panel Hearing was not held. Instead, the Planning Panel process was conducted ‘on the papers’ with the support of all parties and took place over a period of 3.5 weeks, ending on 22 April 2020. The Panel acknowledged the positive. This process ended on 22 April 2020.

Panel Report
The Panel report was received by Council on 5 May 2020. The report was made publicly available on 2 June 2020.
Public exhibition took place from 12 September to 25 October 2019.
In total, 26 submissions were received (including one late submission), of those:
On 11 December 2019, Council's Planning Committee decided to refer all submissions and the amendment to an independent planning panel for review. At that same meeting, Council's Planning Committee endorsed a response to the issues raised in submissions. This response will be used as the basis for Council's submission to the planning panel.
The late submission was received after the Planning Committee hearing and was referred directly to the Planning Panel.

The amendment is required to give statutory effect to the recommendations of the Tiuna Grove Heritage Assessment (Peter Andrew Barrett, 2019) through making the necessary changes to the planning scheme.
The assessment considers the houses at 3, 5, 7 and 15 to be part of the historic development of the area in the early twentieth century, which was stimulated by the Victorian Railways electric tramway established in 1906 (closed 1959). Aesthetically, the houses are early and fine examples of mid 1910s and 1920s bungalow styles.
The assessment recommends that the boundaries of the HO8 precinct applying in Elwood: Glenhuntly and Ormond Rds to be realigned to include the housing at 3, 5, 7 and 15.
The amendment also proposes to remove the contemporary development at the southwest end of Tiuna Grove (21-23, 25, 27, 29 and 31 Tiuna Grove) as it is no appreciable heritage value to the precinct from HO8.
Interim heritage controls were applied to 3, 5, 7 and 15 Tiuna Grove, Elwood, and came into into effect on 4 July 2019. For more information on the interim, visit the Amendment C173port webpage.
