Amendment C173port - Tiuna Grove, Elwood - Interim Heritage Overlay

Amendment C173port applies interim heritage controls to 3, 5, 7 and 15 Tiuna Grove, Elwood while permanent controls are pursued via a separate planning scheme amendment process.

The request for interim controls is based on heritage advice received from independent heritage consultant Peter Andrew Barrett. The advice considers the houses at 3, 5, 7 and 15 to be part of the historic development of the area in the early twentieth century, which was stimulated by the Victorian Railways electric tramway established in 1906 (closed 1959). Aesthetically, the houses are early and fine examples of mid 1910s and 1920s bungalow styles. The advice recommends that the boundaries of the HO8 precinct applying in Elwood: Glenhuntly and Ormond Roads to be realigned to include the housing at 3, 5, 7 and 15.

At its Ordinary Council Meeting on 19 June 2019, in response to a petition from the community opposing the proposed development at 1, 3 and 5 Tiuna Grove, Elwood; Council resolved to urgently request the Minister for Planning to prepare and approve Amendment C173port to the Port Phillip Planning Scheme, pursuant to section 20(4) of the Planning and Environment Act 1987. 

Proposed Amendment C173port would make the following specific changes to the Port Phillip Planning Scheme to extend HO8 to 3, 5, 7 and 15 Tiuna Grove, Elwood on an interim basis:

• Update Port Phillip Planning Scheme Map 8HO to extend the boundaries of HO8
• Update the Schedule to Clause 43.01 – Heritage Overlay to add interim HO8
• Consequential changes would also be made to the Port Phillip Heritage Review Incorporated Document to:
  • Apply an interim ‘Significant Heritage Place’ grading to 3, 5 and 15 Tiuna Grove, Elwood, and an interim 'Contributory Heritage Place' grading to 7 Tiuna Grove, Elwood on the City of Port Phillip Heritage Policy map.
  • Remove the 'Contributory outside of the Heritage Overlay' grading from 3, 5, 7 and 15 Tiuna Grove on the City of Port Phillip Neighbourhood Character Map.
• Make consequential changes to the Port Phillip Planning Scheme, including Clause 21.07 (incorporated Documents), Clause 22.04 (Heritage Policy) and the schedule to Clause 72.04 (Documents incorporated in this scheme) to update the version number and date of the Port Phillip Heritage Review, City of Port Phillip Heritage Policy Map and City of Port Phillip Neighbourhood Character Map.

Council has also resolved to seek Ministerial Authorisation to prepare and exhibit an amendment to the Port Phillip Planning Scheme, to update the Heritage Overlay on a permanent basis via Amendment C174port.
