Amendment C171port - St Kilda Marina

The amendment seeks to:

• Specify the uses allowed and the development outcomes required on the Marina site consistent with the Site Brief.
• Ensure that the design and usage outcomes for the site are reflected in a Master Plan (also referred to as the Development Plan).
• Provide more comprehensive heritage protection based on the available Heritage Assessment.
• Ensure on-going and improve community access to, and use of, the site with high quality public spaces.
• Provide certainty to all stakeholders for those who invest in the redevelopment/renewal of the Marina precinct.

What the amendment changes:

Proposed changes to the St Kilda Marina planning controls (adopted by Council on 17 June 2020) to implement the St Kilda Marina Site Brief, seek to:

• Rezone the site from PPRZ to the Special Use Zone with a new schedule 4 SUZ4
• Apply the Development Plan Overlay with a new schedule 2 DPO2

At its meeting on 17 June 2020, Council resolved to adopt Amendment C171port with changes pursuant to section 29 of the Planning and Environment Act 1987.

Council adopted Panel’s recommendations and recommended modifying the Amendment documentation to reflect the changes proposed by the Panel, with the exception of the recommendation to include a requirement for a Community Engagement Report as part of the Development Plan in DPO2.

Instead, Council resolved to undertake non-statutory consultation on the Development Plan, once an application is received, prior to Council making any planning decision on the Development Plan. A ‘virtual’ Planning Panel Hearing which was available to anyone who wished to participate or attend took place over three days on 6, 7 and 16 April 2020.  Due to the impact of the COVID-19 pandemic, the Panel had to reschedule the hearing dates to ensure this matter could be heard without prejudice to any submitters who wished to be heard. With the support of Council and submitters, this was managed in a timely and inclusive manner. While Council’s submissions were made in writing and distributed before the virtual panel hearing commenced, all evidence was lodged in writing, before the virtual panel hearing commenced, presented orally and then tested by cross examination by both the submitters and the panel over a video conference facility.  The Panel was satisfied that all submitters seeking to be heard were able to fully present to the Panel.

The three-person Panel considered all written submissions received to the Amendment, including verbal submissions made during the Panel Hearing by six residents and two representatives of groups of submitters - a town planning consultant representing 93 submitters (the content of their submissions was the same), and a resident presenting on behalf of 31 residents (who submitted a single submission).

After the hearing, the Panel Report was sent to submitters and made publicly available on 10 June 2020.

The Minister for Planning (through delegation on the 25 September 2019) provided authorisation to prepare and exhibit Amendment C171port to the Port Phillip Planning Scheme.

The City of Port Phillip placed the amendment on public exhibition from the 17 October 2019 to 18 November 2019. Public exhibition has now closed.
