Amendment C151port - 77 Park Street, South Melbourne - Permanent Heritage Controls

Amendment C151port provides permanent heritage controls for 77 Park Street, South Melbourne which was identified by an independent heritage consultant acting on behalf of Council as being of local heritage significance.

It involves applying the heritage overlay to the property and amending relevant incorporated documents to the Port Phillip Planning Scheme.

Applying a Heritage Overlay will ensure heritage matters are considered in any future planning permit application.

Specifically, Amendment C151port will make the following changes:

• Apply a Heritage Overlay (HO504) to 77 Park Street, South Melbourne on a permanent basis by:
  • retaining the current designation of HO504 on Port Phillip Planning Scheme Maps 3HO and 4HO;
  • updating the Schedule to Clause 43.01 – Heritage Overlay to make HO504 a permanent control with no expiry date;
  • updating Clause 21.07 – Incorporated Documents, Clause 22.04 – Heritage Policy and the Schedule to Clause 72.04 – Incorporated Documents, to reflect the revised version number and date of the Port Phillip Heritage Review, and the City of Port Phillip Heritage Policy Map.
• The changes in the above Incorporated Documents comprise:
  • introduction of a new individual citation (Citation No 2392) for 77 Park Street, South Melbourne, in the Port Phillip Heritage Review;
  • application of a ‘Significant Heritage Place’ grading to 77 Park Street, South Melbourne, on the City of Port Phillip Heritage Policy Map.

Previously, amendment C150port was introduced to put interim heritage controls on the property. These controls were scheduled to expire 31 December 2018, but these have now been superseded by Amendment C151port.

During the exhibition of Amendment C151port from 29 January to 5 March 2018, 23 submissions were received. 22 of these submissions were in support, and one submission was in opposition of the amendment.

Through negotiations, Council officers resolved the issues raised in the opposing submission, and sought the adoption of Amendment C151port from Council.

Council considered the report and officer recommendations at its meeting on 1 August 2018 and adopted Amendment C151port, pursuant to section 29 of the Planning and Environment Act 1987.

The adopted Amendment C151port was submitted to the Minister for Planning for approval.

On 31 July 2018, Amendment VC148 - Reforms to the Victoria Planning Provisions (VPP) was gazetted. This amendment focused on changes to the VPP and planning schemes, including improvements to the structure and operation of specific zones, overlays and particular provisions. As a result of this, the documentation submitted to the Minister for Planning for Amendment C151port differs slightly from that exhibited. The schedule to Clause 81.01 - Incorporated Documents, no longer exists under the new structure, and has been replaced by the schedule to Clause 72.02, which contains identical information.

An application to demolish the buildings at 77 Park Street and 286-294 Kings Way, South Melbourne was received pursuant to section 19A of the Building Act 1993 (Demolition) on 18 August 2017. There was a live planning application (P239/2017) to construct a seven (7) storey development on these two sites.

77 Park Street, South Melbourne, contains the former Church of Our Lady of the Assumption that has been identified as being of local heritage significance, but was not protected by a Heritage Overlay.

On 17 November 2017 the Minister for Planning approved Amendment C150port to apply interim heritage controls to 77 Park Street, South Melbourne. The interim controls expire on 31 December 2018.
